1. Acceptance and eligibility
By accessing or using Optifocus, you agree to these Terms of Use and our Privacy Policy. If you use Optifocus for an optical store or another organization, you confirm that you are authorized to bind that organization. Do not use the service if you do not agree.
You must be legally capable of entering a binding agreement and must use the service only for authorized professional purposes. Customers do not need to create an operator account merely to be measured.
2. What Optifocus provides
Optifocus provides a guided workflow for customer consent, image capture, assisted optical-measurement proposals, operator review, corrections, and reporting. Features may be limited during pilots, trials, beta releases, or staged rollouts.
Optifocus is not a diagnostic, treatment, or final-prescription service. Automated output is a proposal that requires review and confirmation by an appropriately trained optical professional.
3. Accounts and store access
- Provide accurate registration information and keep it current.
- Protect your device, phone account, OTPs, and access credentials. Do not share operator accounts.
- Store owners are responsible for assigning and removing staff access promptly.
- Notify us immediately of suspected unauthorized access or compromised credentials.
- You are responsible for activity performed through your account unless caused by our breach of these terms or applicable law.
4. Operator and store responsibilities
Stores and operators must use professional judgment and follow applicable optical, consumer, privacy, and record-keeping requirements. In particular, you must:
- Confirm the customer’s identity and authority to consent, including parent or guardian authority where required.
- Present the current consent notice before capture and respect refusal or withdrawal.
- Use supported devices and agreed operating conditions, follow capture guidance, and reject or retake unsuitable captures.
- Review proposals, confidence information, warnings, and corrections before confirming or sharing a result.
- Never represent Optifocus output as a diagnosis, treatment recommendation, or independently sufficient prescription.
- Access only customers and records belonging to your authorized store and legitimate workflow.
5. Acceptable use
You must not misuse Optifocus. Prohibited conduct includes attempting unauthorized access; bypassing authentication, consent, rate limits, or security controls; uploading unlawful, malicious, deceptive, or unrelated material; reverse engineering except where law expressly permits it; scraping or reselling the service; interfering with availability; testing vulnerabilities without written authorization; or using output to make unsupported medical or discriminatory decisions.
6. Customer data, privacy, and feedback
You retain responsibility for data you submit and grant Optifocus the limited rights needed to host, process, transmit, analyze, and generate reports from it to provide and secure the service. You confirm that you have a lawful basis and all required notices and permissions for submitted data.
Our handling of personal data is described in the Privacy Policy. Do not submit data that is unnecessary for the supported workflow. If you provide suggestions or feedback, we may use them to improve Optifocus without an obligation to compensate you.
7. Intellectual property and third-party services
Optifocus, its software, branding, workflow, documentation, and related intellectual property belong to Optifocus or its licensors. Subject to these terms and any pilot or subscription agreement, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service for its intended purpose.
The service relies on third parties such as Firebase and Amazon Web Services. Their availability and terms may affect parts of the service. Links to third-party sites do not imply endorsement.
8. Pilots, updates, and availability
We may add, change, suspend, or discontinue features, introduce usage limits, or require an update for security or compatibility. Pilot and beta functionality may contain errors and is provided for controlled evaluation under agreed conditions. Keep independent procedures for any activity where service interruption could cause harm.
Fees, taxes, billing periods, renewals, and refunds, if applicable, will be stated in the order, pilot, or subscription terms presented to the store.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law, the service is provided “as is” and “as available”. We do not warrant uninterrupted availability or that assisted results will be error-free or suitable without professional review. Nothing in these terms excludes rights or liabilities that cannot lawfully be excluded.
To the maximum extent permitted by law, Optifocus will not be liable for indirect, incidental, special, exemplary, or consequential loss, loss of profits or data, or decisions made without the required professional review. Any aggregate liability will be limited as stated in the applicable commercial agreement or, if none applies, to the amount paid for the service during the three months preceding the event giving rise to the claim.
10. Suspension and termination
You may stop using the service at any time. We may suspend or terminate access for material breach, security risk, unlawful use, non-payment, or where required by law. Where reasonably possible, we will provide notice and an opportunity to remedy the issue. Provisions concerning ownership, payment obligations, disclaimers, liability, disputes, and records that must be retained survive termination.
11. Changes, governing law, and contact
We may update these terms to reflect service or legal changes. Material changes will be posted with a revised effective date. Continued use after an update takes effect means you accept the revised terms where permitted by law.
These terms are governed by the laws of India. Courts having jurisdiction over Optifocus’s registered office will have jurisdiction, subject to any mandatory consumer rights or dispute process that applies.
